Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between you and Trinity Web Guys, LLC ("Trinity Web Guys," "we," "us," or "our"). They govern your access to and use of https://trinitywebguys.com (the "Site") and any website design, hosting, maintenance, support, or related services we provide (collectively, the "Services").

By accessing the Site, submitting an inquiry, or purchasing or using the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

Our Privacy Policy (https://trinitywebguys.com/privacy) explains how we collect and use personal information and is incorporated by reference.

You may use the Site for lawful purposes only. You agree not to:

• Attempt to gain unauthorized access to the Site, related systems, or data
• Interfere with or disrupt the Site or Services
• Use the Site to transmit malware, spam, or unlawful content
• Scrape, harvest, or systematically extract content except as permitted by applicable law or with our prior written consent
• Misrepresent your identity or affiliation when contacting us

We provide website design and build services, hosting, maintenance, updates, and support under subscription plans described on our Pricing page. Marketing claims such as "$0 down," month-to-month billing, and cancel-anytime availability describe our standard commercial offering and remain subject to these Terms, the plan you select, and any written confirmation we send you.

Plan features, pricing, and included allowances are those published on the Pricing page at the time of your purchase, unless we agree otherwise in writing. We may update published plans for new customers; existing subscriptions continue under the plan terms in effect when you purchased, except where these Terms expressly allow changes.

Custom or bespoke engagements may be scoped separately and may include additional written terms.

You are responsible for providing accurate contact and billing information and for timely delivery of content, assets, brand guidelines, credentials, and access we reasonably need to perform the Services.

You represent that you own or have all rights necessary to provide materials to us, and that our use of those materials to deliver the Services will not infringe third-party rights. You grant us a non-exclusive license to use, reproduce, and display your materials as needed to provide and maintain your website and related Services.

You remain responsible for the legality and accuracy of content published on your website, including claims about your business, products, and services.

Launch-tier sites are hosted on a subdomain we provide. They do not include a custom domain registered by us.

On Standard tier and above, when a custom domain is included with your plan, the domain is registered and held by Trinity Web Guys, LLC for the duration of your active subscription. The domain remains under our registration and control while you subscribe.

Custom domains are not transferred to you upon cancellation, non-payment, or termination of the Services. If your subscription ends, you will lose the right to use that domain through our Services unless we expressly agree otherwise in writing. Domain registration costs for standard TLDs and any premium or non-standard domain pass-through charges are as described on our Pricing page.

We are not responsible for delays or outages caused by domain registrars, DNS providers, or other third parties outside our reasonable control.

Subscription fees are billed in advance on a recurring monthly or annual basis, as selected at checkout or as otherwise agreed. Payments are processed by Stripe, Inc. Applicable sales tax may be calculated and collected through Stripe where required.

You authorize us (and Stripe) to charge your selected payment method for recurring fees and any agreed add-on charges. Failed payments may result in suspension or termination of Services.

You may upgrade or downgrade plans subject to our then-current offerings and any transition we communicate to you. Downgrades may reduce included features, pages, or update allowances.

You may cancel anytime. Cancellation stops future billing according to the billing cycle and cancellation process we provide. Upon cancellation or termination:

• Access to hosting and related Services will end at the end of the paid period or sooner if we terminate for cause
• We may remove or disable your website
• Custom domains held by us are not transferred to you
• Fees already paid are non-refundable except as expressly provided in the Satisfaction Guarantee or required by law

If you are unsatisfied with the overall design direction of your first draft, you may request a full refund within fourteen (14) days of first draft delivery. The fourteen-day period begins on the date we deliver the first draft to you — not on the date of signup or first payment.

This guarantee applies once per new client relationship.

The Satisfaction Guarantee does not apply to:

• Requests for pages or features beyond your selected tier
• Delays caused by you not providing content, assets, credentials, or other access we reasonably need
• Ongoing revision cycles after the first draft has been reasonably approved
• Domain, DNS, or third-party issues outside our control

Each subscription tier includes a defined number of update requests as published on our Pricing page at the time of your purchase. Unless your plan confirmation states otherwise, the standard allowances are:

• Launch: 1 update request every other month
• Standard: 1 update request per month
• Growth: 4 website update requests per month
• Custom: Unlimited updates

By subscribing to the Services, you grant Trinity Web Guys, LLC the right to feature your website in our public portfolio and marketing materials, including screenshots, a description of work performed, and a link to the live site.

If you have confidentiality concerns, contact us before signing up so we can discuss available options.

Your website or our Services may integrate or embed third-party tools (for example, booking widgets, payment links, maps, analytics, or chat products). Those tools are provided by third parties under their own terms and privacy policies. We are not responsible for third-party availability, security, pricing, or practices.

Where we help configure a third-party integration as part of your plan, you remain responsible for maintaining any required third-party accounts and complying with those providers' terms.

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site or Services will be uninterrupted, error-free, or free of harmful components, or that your website will achieve any particular ranking, traffic, revenue, or business result.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRINITY WEB GUYS, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, SERVICES, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE, SERVICES, OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Trinity Web Guys, LLC and its members, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content or materials; (b) your use of the Site or Services; (c) your breach of these Terms; or (d) your violation of any law or third-party right.

We may suspend or terminate access to the Site or Services immediately if you breach these Terms, fail to pay fees when due, misuse the Services, or if continued service would create legal, security, or operational risk.

Provisions that by their nature should survive termination (including intellectual property, domains, portfolio rights, disclaimers, limitation of liability, indemnification, and governing law) will survive.

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes will be posted on this page. Your continued use of the Site or Services after changes become effective constitutes acceptance of the updated Terms, to the extent permitted by law.

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. You agree that exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms, the Site, or the Services will lie in the state or federal courts located in Indiana, and you consent to personal jurisdiction in those courts.
